General litigation is the term for court action in resolving disputes
or claims between individuals, companies, local authorities and
government departments.
Generally such matters fall into two categories. One is based on
contract being an agreement between two or more parties and the
other is based on a civil wrong caused by one party to another either
deliberately or negligently.
The range of disputes based on contract can vary from the case
of a householder suing a contractor for failure to perform a landscape
garden contract correctly to a multi million pound claim arising
as a result of late completion of a building contract. Civil wrongs
include cases of personal injury and damage to property and reputation.
Your solicitor, your accountant or your financial adviser may have
been negligent in their advice to you so let us help you.
You may be the victim of harassment. If so, you may be entitled
to an injunction to prevent this. Injunctions can be obtained by
our litigation solicitors speedily and can be very effective in
ending intimidation.
You may be dissatisfied with the extension to your house, your
conservatory, your new kitchen or bathroom. Other tradesmen may
be in breach of their contract with you – let us advise how
best to deal with your claim.
Your surveyor may have been negligent in reporting on the condition
of the house you have just bought. Problems that your surveyor has
missed may appear after you move in and again we are here to assist.
If you are involved in a dispute with another individual or company
we can advise you on your chances of success and the possible value
of your claim.
We will advise you on the best steps to take to try to avoid or
resolve disputes without having to resort to court proceedings where
appropriate. We can negotiate on your behalf and if necessary commence
or defend proceedings which, according to the subject matter and
the amount of the claim, will be dealt with in either the County
Court or the High Court. We will inform you of the litigation risks
throughout the case.
We advise on methods of enforcement: from bailiffs and sheriffs
to garnishee proceedings and charging orders.
We can in appropriate cases consider no-win, no-fee arrangements.
Insurance is now available to both individuals and companies to
cover the costs of litigation in all kinds of disputes, and we can
assist in making such applications to enable you to budget for litigation.
In short whatever problem you face, our litigation solicitors will
be able to help you through the legal maze.
